WLTC Adopts Budget, Introduces New Ordinance

At the meeting of the Winona Lake Town Council on Tuesday, Oct. 21, the council adopted its budget for 2015. The advertised 2015 budget can be seen here.

As stated in previous meetings, next year’s tax-supported budget is projected to decrease 2.2 percent in 2015. The fee-supported budget is to decrease 6.2 percent, resulting in an overall decrease of 4.3 percent.

The council also introduced Ordinance No. 2014-11-1, which would stagger terms for council members. The council stated that with the way elections are currently set up, the entire council could be totally replaced at any given election. The council members felt this could be detrimental to town business.

Town Attorney James Walmer referenced an incident in Orland where council members signed contracts for a sewage project. Many townspeople didn’t care for the sewage project, voted out all the council members and the new council members cancelled the contracts.

When the whole incident was said and done, it cost the town nearly a half million dollars, with no work done on the sewage project. Regarding the ordinance in Winona Lake, Walmer said, “That’s the idea, trying to avoid a problem where everybody comes in at once.”

The ordinance proposes that next year two council members would be elected for three-year terms. The following year three council members would be elected for four-year terms.

“What’s this going to cost the town financially?” asked councilman Terry Howie. The ordinance would require the town to host an additional election, which would impose additional costs on the town. Ultimately, the council voted to introduce the ordinance, but will not vote on it until further research on additional costs is completed.

In other news, Deputy Clerk-Treasurer Cindy Nolton recently received Indiana Municipal Clerk Certification. She attended training and completed requirements prescribed by the Indiana League of Municipal Clerks and Treasurers. Nolton was honored at the meeting.

Additionally, all claims were approved, including an invoice for the 7th Street sidewalk project. Town Engineer Larry Long said this was not the original invoice from Construction Resources.

“I didn’t approved [the first invoice] because I needed to walk the site and make sure the invoice relates to the work that was done. We had some issues with that,” said Long. “They just got me a revised invoice, which is lower. I’m asking that you approve this one.”

“It’s shaking out that we’re going to be less than the $50,000 that [the council] approved,” continued Long. The submitted invoice was for $16,153. Long also reported some additional work around Wooster Road was completed as part of the project, but the whole project is going to end up costing closer to $45,000.

 


Columbia City Man Arrested For Child Molestation

On Tuesday, Oct. 21, Gregory A. Moening, 31, 4614 E. Old Trail Drive, Columbia City, was booked at the Kosciusko County Jail for molestation of a child under 14 years of age.

According to a probable cause affidavit from the Kosciusko County Prosecutor, Moening’s wife received a message via Facebook from the alleged victim on Sept. 16, in which she stated that she had been sexually abused by Moening.

The victim later informed a Child Protective Services Investigator that sometime around the end of May 2012 and early June 2012 she had been visiting a friend at a location. Moening had also been present. According to the victim, she was wearing a low-cut shirt and when she bent over Moening asked, “since I have seen one, can I see the other?” The victim further advised either later on that day or the next day was when the inappropriate sexual contact occurred.

The victim advised due to the significant age differential between her and Moening, who was 29 at the time, she had felt too ashamed to tell anyone about the incident previously.

Moening was booked on a $5,000 surety bond.

Pierceton Woman Arrested For Forgery

Suzanne Kinney, 70, of 5331 E. Old Road 30, Pierceton, was booked at the Kosciusko County Jail for forgery on Tuesday, Oct. 21.

Kinney’s charges are the result of a July incident involving the title information of a 1998 Jeep Grand Cherokee automobile.

According to the victim, she had traveled to Hudson to live a relative but had left her Jeep with her roommate at her previous residence. Upon returning from Hudson, she found Kinney had forged her name on the car’s title and transferred it into her own name. The victim advised she had not given Kinney permission to do this.

Kinney admitted that she had forged the other party’s name on the title for the car and sent it to Indiana Bureau of Motor Vehicles. She also stated the title was issued in her name on July 3.

Kinney was booked on a $2,000 surety bond.

Engle Takes The Stand During Jury Trial

UPDATE: The case against Engle resumed at 2 p.m. today. At 2:44 p.m. it was handed over to the jury. The jury is currently deliberating.

The second day of a three-day jury trial to determine the fate of a man accused with two counts of sexual misconduct with a minor began this morning shortly after 11 a.m. in Superior Court I under the jurisdiction of Judge Duane Huffer. The court heard testimony this morning from Franklin L. Engle, 35, of Warsaw, who is accused of two counts of sexual misconduct with a minor, both Class B felony charges.

Yesterday, members of the jury and court heard testimonies from the two reported victims, Warsaw Police Det. Brad Keller, Kosciusko County Sheriff’s Department Det. J.D. Ayers and the mothers of the two alleged victims (see related).

Though Engle was not legally bound to testify, he took the stand today claiming the jury deserved to hear his account of what occurred between him and the two victims.

Events began around May 28, 2012, when both victims attended a family camp-out at their grandparent’s home near Mentone, where Engle and his former wife both resided at the time. Engle stated that though the 14-year-old victim reported she was touched inappropriately, had touched Engle inappropriately and had had anal sex with Engle, none of her statement was true. Engle stated he had been playing card games with both alleged victims inside the house, which was accessible to other family members who were gathered at the home for the camp-out.

When asked about the second alleged misconduct, which reportedly involved a 15-year-old several months later in the sleeper of Engle’s semitractor at a truck stop in Gary, Engle also denied the allegation. Engle stated he was bringing the young teen home from visiting with grandparents in Wyoming and had received a permission slip from the girl’s mother to travel in his semitractor. Engle denied ever stopping in Gary, stating his log book showed he had not been in Gary and his previous claim he had stayed in Gary was incorrect and was made because he did not have his log book with him at the time of his interview with Det. J.D. Ayers.

No adult was told of the allegations until questioned by police in the fall of 2012.

The investigation began in November 2012. when Engle’s former wife, Ashley, brought disturbing messages to police that she found on several electronic devices. One such message indicated the sender (assumed to be Engle) had sex with relatives. Several other messages were discovered, including an alleged conversation with a 12-year-old.

Yesterday during questioning by Bolinger, both Ayers and Warsaw Police Det. Brad Kellar stated it was not verified who sent the messages. Yet testimony was heard that Engle and his former wife were the only ones with access to the computer.

Engle denied having conversations with minors through an electronic device but did admit to having correspondence with a prostitute, whom he called “Kitty Cat”, from Fort Wayne as well as an additional adult woman. Engle noted that he had received a new phone just prior to the initial interview with Ayers.

Court proceedings will reconvene today at 1:30 p.m. following a lunch period.

 

 

 

Whitko Marching Pride Doing Big Things With Little

“The bands we’re going up against have 50 or 60,” says Joseph Shepherd, the band director at Whitko High School. Whitko Marching Pride is working with a mere 17 members, but that hasn’t stopped them from becoming one the best marching bands in the state this year.

“I was a student here when the band was bigger,” Shepherd, a 2003 graduate of Whitko High, says. “We were very competitive in the state when I was here. I wanted to bring it back to what it was.”

What he lacks in quantity, Shepherd, now in his third year as Whitko’s band director, makes up for with quality. His students are remarkably talented, and he has a knack for connecting with audiences.

“We play a lot of current stuff. My first year here we did ‘Party Rock Anthem,’ and we did the full dance,” he says. “That’s what made people take notice. The student section enjoys the music. They cheer for us at games.”

“We’re ranked very high in the state,” says Shepherd. The band earned second place in its last competition, and this weekend it will be headed down to Indianapolis to compete in the ISSMA Scholastic Class MB Finals at Lawrence High School. The band will be performing “A Love Story,” set to Bruno Mars’ “Runaway Baby/Locked Out of Heaven,” “When I Was Your Man,” featuring an alto saxophone solo Morgan Puterbaugh, and “Marry You,”

Though Shepherd has been successful with his small band, he would like to see the numbers grow. “Last year I did a ton of recruiting,” he says. “We play in the community as much as possible.”

He even went so far as to call every fifth grade grade parent to ask if their kid might be interested in playing in the band. “Our middle school numbers are very good,” Shepherd says. “Hopefully it will grow.”

But if it doesn’t: “It doesn’t matter how small you are,” says Shepherd. “You can still have a good sound and be competitive.”

Engle Not Guilty On One Count, Hung Jury On Second Count

After four hours of deliberation, the six-man, six-woman jury could not reach a decision against Franklin Engle on count one of sexual misconduct with a minor, a class B minor. They found him not guilty on sexual misconduct with a minor on count two, also a class B minor.

The jury foreman told Judge Duane Huffer they were unable to reach a unanimous decision as set forth by the judge. Huffer asked if the court allowed additional time for review of evidence and further deliberation, could a decision be reached?

The foreman stated “afraid not. We’re deadlocked.”

More details of the trial will be available Thursday.

Update: Fire At Better Way Products

New Paris Fire Department  requested a full assist from Milford Fire Department along with tankers from Leesburg and Turkey Creek fire territories at a structure fire this morning.

The local agencies responded to a multiple alarm fire at Better Way Products Plant 2 on CR 23, between US 6 and CR 50, New Paris. Fire departments from at least five other agencies have also been called in.

The initial call was around 2 a.m. Shortly after 3 a.m. the additional manpower was requested. The fire was brought under control at 6:35 a.m.

Tankers are being refilled approximately one-fourth of a mile away at an irrigation well, at New Paris Fire Station and New Paris Elementary School.

Warsaw Fire Department has been put on standby for the Milford and Leesburg departments.

We will have further information from New Paris Fire Chief Joe Warstler later today.

Syracuse Woman Flown to Memorial

Cassandra Rautenkranz, 28, Syracuse, was airlifted from Goshen Municipal Airport to Memorial Hospital, South Bend, following an accident Wednesday morning.

Rautenkranz suffered a laceration to her head. She was transported to the airport by ambulance.

The accident occurred at 11:38 a.m. on US 33 south of CR 42, near Benton. Elkhart County Sheriff’s Department reports Rautenkranz was northbound on US 33, south of CR 42. For an unknown reason her vehicle went left of center and hit a southbound semitrailer.

Melkemu Lombeso, 31, Cincinnati, Ohio, was driving a Freightliner semitractor southbound, hauling a semitrailer, when he saw the vehicle hit the semitrailer.

Police report there was extensive side impact damage to Rautenkranz’s 2001 Mitsubishi Eclipse and extensive damage to the driver’s side of the trailer.

Rautenkranz was cited for driving left of center.


UPDATE: Man Injured In Forklift Accident

UPDATE: Kosciusko County Sheriff’s Department deputies and emergency personnel responded today at approximately 11:02 a.m. to the location of the Creighton Brothers Processing Plant, 6500 W. Crystal Lake Rd., Warsaw, in regards to a forklift accident.

Officers were initially advised that an employee was pinned underneath a forklift near the loading-dock portion of the business. Mentone and Multi-Township E.M.S. arrived at the scene and located the victim, Arnold Shepherd, 52, of Warsaw, who had a visible open compound fracture and injury to both legs. Shepherd was immediately transported to Lutheran Hospital, Fort Wayne, in serious condition.

K.C.S.D. officials stated that a preliminary investigation has determined that a semi-tractor/trailer had initially backed into the loading dock area at the Creighton Brother Processing Plant, driven by Robert Carpenter, Texas. Carpenter purportedly noticed that he had backed his trailer into the loading dock at an slight angle, and proceeded to pull forward in an attempt to straighten the vehicle. At apparently the same time, Arnold Shepherd had begun to drive forward and into the enclosed semi-trailer unit with a forklift. During the course of movements, the forklift fell from the open-end of the trailer. Shepherd was subsequently ejected from the forklift and pinned underneath the 2,000 lb. unit.

The Atwood Fire Department was initially dispatched to the scene, as was a medical helicopter, but were both later disregarded as Shepherd was extricated by scene personnel.

Though the weight involved in the forklift/incident was initially reported by officials to weigh 10,000 pounds, a media release from Creighton Brothers, Inc. indicates the weight was 2,000 pounds. 

Initial Report: Medics are transporting a 51-year-old individual to Lutheran Hospital following an industrial accident at 6500 W. Crystal Lake Road.

The Kosciusko County Sheriff’s Department is at the scene and is investigating the accident and will release information later today.

Atwood Fire Department and emergency personnel were called at 11:10 a.m. to Crystal Lakes, 6500 W Crystal Lake Road, where a man had been injured in a forklift accident. The reported 5-ton forklift had 10,000 pounds of product on it when it reportedly fell on the individual’s leg.

Syracuse Man Arrested For Theft, Drug Charges

Kosciusko County Sheriff’s Drug Task Force deputies, along with officers from Syracuse Police Department, arrested Jason Paul Halsey, 40, 9485 N. SR 13, Syracuse, for theft and various drug charges.

According to a press release from KCSD, at approximately 6 p.m. Wednesday, Oct. 23, law enforcement executed a search warrant at 9485 N. SR 13 in Syracuse. Upon entering the property, officers took Halsey into custody without incident. Items associated with meth production were found, as well as substances believed to be a synthetic drug.

The investigation on Halsey originally began when SPD officers identified him as a suspect in a theft from Syracuse Ace Hardware. The power drill stolen from the hardware store was also located at Halsey’s residence.

Halsey is preliminarily charged with felony theft, possession of synthetic drug/cannabinoid and possession of precursors used in the production of methamphetamine. His bond was set at $2,000. The Kosciusko Count Prosecutor’s Office also assisted KCSD and Syracuse police with the investigation. The prosecutor’s office advises that all defendants are presumed innocent until proven guilty in a court of law.

Warsaw Police Department Narcotics Unit executed multiple felony warrants for illegal drugs Wednesday, Oct. 22. As a result, the following individuals were arrested and booked into the Kosciusko County Jail:

Kimberly Ann Click, 52, 200 Lakeview Drive, Winona Lake, for dealing in a narcotic drug (heroin), a Level 5 felony.

Lester Miller, 52, 200 Lakeview Drive, Winona Lake, for dealing in a narcotic drug (heroin), a Level 5 felony.

Brody Jordan, 20, 1909 Miami Drive, Warsaw, for dealing in a narcotic drug (heroin), a Level 4 felony. Charges have been enhanced to a higher level felony due to gang activity.

Mark Daniel Slone, 33, 8280 E. US 30, Apt. 31, Pierceton, for Dealing in a Schedule I, II, or III controlled substance, a Level 5 felony.

Additional charges have been filed with the Kosciusko County Prosecutors Office on the above individuals. More arrests may be forthcoming. Wawasee Burglaries Solved With Arrest

One individual has been arrested in connection with burglaries of Lake Wawasee homes May 19. Warrants have been issued for others involved, but no one else has  been arrested at this time.

Robert Tyler Boatwright, 24, 10937 N. 200E, Milford, was arrested Wednesday, Oct. 22, by Milford Police. He is being held on a $10,000 surety bond.

Court records show at 1:31 a.m. May 19, a Kosciusko County Sheriff’s deputy responded to a burglary alarm at the home of Lloyd Hagedorn, Lung Lane, Syracuse. The home had been entered and burglarized by forcing open a window. The officer finished their investigation at 2:23 a.m.

An officer with North Webster Police stopped a vehicle occupied by three individuals, at 2:31 a.m., at East Wawasee Drive and Cinderella Drive. This was north of where the burglary took place. Two of the three individuals were identified. The third provided police with a name and date of birth, indicating he was a juvenile, stating he had no identification in his possession.

Later that day, at 7:30 p.m., another county officer responded to a burglary report at the residence of Jim Heubi, North Bayshore Drive, Syracuse. An individual had noticed the front door to the home was opened.

The officer also found the home of Heubi’s next door neighbor, Glenn O’Conner, had been broken into by prying a window open. It was learned these homes were relatively close to the burglary investigated at 1:31 a.m.

At a later time, Kosciusko County Crimestoppers received a tip that Boatwright was in the vehicle North Webster Police had stopped, but had given a false name. The tip also indicated those individuals were involved in burglaries of lake homes.

Through an investigation, police learned the name of Boatwright’s girlfriend. Both Boatwright and his girlfriend had an undisclosed warrant.

The girl friend was arrested. When Boatwright came to bond her out, he was also arrested on the active warrant.

Police questioned Boatwright about May 19. He admitted he was in the vehicle and gave the false name to avoid being arrested.

Shoes, being worn by Boatwright, were obtained and compared to a shoe print left on a windowsill at O’Conner’s home. The shoe prints were similar.

Police questioned the other individuals, who were in the vehicle in the early hours of May 19. The driver of the vehicle stated Boatwright had told him to stop at his mother’s home to get things. The driver noted they stopped at a house near a lake.

The other individual said Boatwright was at a residence and had told them to back the vehicle up to the home. There Boatwright carried out a small television and a comforter and placed the items in the vehicle.

Police spoke with Boatwright’s mother and the juvenile, whom Boatwright had identified himself as. It was confirmed the juvenile did not give permission or consent for Boatwright to use his identifying information.

Boatwright’s mother told police she did not live near a lake, but lived in Milford. She also stated her son had not come to her residence to obtain any items the evening of May 19.

Items found at the crime scenes were sent to the Indiana State Police Laboratory for DNA testing. A flashlight found in a paper box produced DNA evidence consistent with Boatwright’s DNA.

GOP Statewide Ticket Hosting Early Vote Rallies

Hoosiers are invited to attend early vote rallies in both Warsaw and Goshen held by the GOP statewide ticket.

Secretary of State Connie Lawson, Auditor of State Suzanne Crouch and Treasurer of State Kelly Mitchell invite supporters to attend two early vote rallies hosted by the Indiana Republican party.

The first will be at the Kosciusko County Republican Party headquarters at 3 p.m. Friday, Oct. 24, located at 112 N. Buffalo St., Warsaw.

The second will be held at the Elkhart County Republican Party headquarters at 8:30 a.m. Saturday, Oct. 25, located at 115 E. Lincoln Ave., Goshen. Candidate for State House of Representatives Curt Nisly will also join the statewide team.

This early vote rally will be a part of Indiana’s Republican statewide team as part of their “Experience and Transparency” bus tour.

Supporters and media are invited to attend either rally for a message from the candidates before taking part in early voting.

Hoosiers do not need a reason to vote early in person. Registered voters will be asked to present a valid photo ID issued by the State of Indiana and complete an application to vote absentee while at the clerk’s office- since any person casting a ballot before Election Day is considered an absentee voter.

Ballots will not be counted until Election Day.

Zimmer Announces Third Quarter Profit Increases

WARSAW – Zimmer Holdings, Inc. (NYSE and SIX: ZMH) today reported financial results for the quarter ended Sept. 30, 2014. The company reported third quarter net sales of $1.11 billion, an increase of 2.9 percent reported and 3.1 percent constant currency over the third quarter of 2013. Diluted earnings per share for the quarter were $0.96 reported and $1.35 adjusted, an increase of 8 percent adjusted over the prior year period.

“Zimmer’s third quarter was marked by solid revenue growth in key product categories and geographies, building on a strong prior year performance,” said David Dvorak, President and CEO of Zimmer. “Our financial results reflect the ongoing execution of our operational excellence initiatives, as demonstrated by continued margin expansion and accelerated earnings growth during the quarter. Looking to future quarters, we believe that our pending combination with Biomet, which we expect to close in the first quarter of 2015, will enhance stockholder value through the creation of a leading innovator in the global musculoskeletal market.”

Net earnings for the third quarter were $165.5 million on a reported basis and $232.6 million on an adjusted basis, an increase of 7.9 percent adjusted over the prior year period. Operating cash flow for the third quarter was $255.7 million.

During the quarter, the company paid $37.1 million in dividends and declared a third quarter dividend of $0.22 per share, an increase of 10 percent over the prior year period.

Earlier this month, Zimmer announced the acquisition of Cambridge, Massachusetts-based ETEX Holdings, Inc. ETEX’s innovative bone substitute material products add more depth to a growing portfolio of solutions for the early stages of joint disease. Zimmer is committed to developing a comprehensive range of biologic therapies for patients suffering from musculoskeletal joint disease.

The company updated its full-year revenue and EPS guidance for 2014. Full-year revenues are now expected to increase approximately 2.25 percent on a constant currency basis from 2013. Previously, the Company had estimated full-year revenues would increase 2 percent to 3 percent constant currency. The Company now expects foreign currency translation to decrease revenues by approximately 0.75 percent for the full year, resulting in reported revenue growth of approximately 1.50 percent.

The company now projects full-year 2014 diluted earnings per share to be approximately $4.65 on a reported basis and approximately $6.05 on an adjusted basis. Prior guidance for full-year 2014 reported and adjusted diluted earnings per share was $4.65 to $4.75 and $6 to $6.10, respectively. This updated guidance reflects estimated charges for inventory and manufacturing related expenses, quality and operational excellence initiatives, certain claims and special items of $250 million on a pre-tax basis, and an additional $70 million for expenses related to the pending Biomet merger, totaling $320 million or approximately $1.40 per diluted share, on an after-tax basis.

WPD Issues Additional Felony Warrants For Dealing Methamphetamine

user27638-1414155979-media1_937d76_192_240_PrsMe_At 2 p.m. yesterday, Thursday, Oct.  23, Warsaw Narcotics officers served two warrants on County Road 175 East, on the north side of Warsaw, following undercover purchases from two (2) suspects back in May and June 2014.

Officers arrested the following people: Tanya N. Helser, 39 years old, of Warsaw, for dealing methamphetamine, a Class B felony; and Jim E. Waid, 34 years old, of Warsaw, for dealing methamphetamine, a Class B felony.

Those who will be unable to participate on Tuesday will have until noon the day before to cast their vote via an absentee ballot. This must be done in the Kosciusko County Justice Building, located at 121 N. Lake St., Warsaw. Absentee office hours are 8 a.m. to 11  a.m. and noon to 4:30 p.m. Monday through Friday.

An Indiana or United States government issued identification is required from all individuals in order to vote. The ID must display your photo, match the name on the voter registration record, display an expiration date and still be current.

Anyone registered to vote is able to cast their ballot for the Nov. 4 election, regardless of whether they voted during the May primaries.

BREAKING: Gas Leak Near Shelden And Poplar Streets

Emergency personnel are currently responding to a large, main gas leak located near Shelden and Poplar streets north of Kohl’s in Warsaw.

A loud sound of gas releasing can be heard in the area. The leak is near the corner of Sassafras Court and Poplar Street in the residential community of Northwest Woods. Warsaw Fire Department is on-scene and a representative from NIPSCO has arrived. NIPSCO is assembling a crew to repair the leak.

According to officials, an excavator struck a 2-3 inch gas line at a home build.
